Cognizance of Corporate Offence

Courts can take cognizance of any offence under the Companies Act 1956, only on complaint in writing by the Registrar of Companies or a Share Holder or any person appointed by the Central Government.

1. Consumer complaint against Daimler Chrysller manufacturer of Benz Mercedes E class car has been filed & admitted, for having manufactured & sold cars with inherently defective power steering which failed & for  having incompatible low road clearance under chassis which certainly gets scraped & damaged on the Indian roads. Benz recalled about 80,000 cars in the USA due to power steering failure after direction by NHTSA ( National Highway Traffic Safety Administration ). In India there is no road safety authority nor product liability laws like in USA, which can rein in such faulty automobiles.

2. Petitioner was deliberately failed in final year BDS University Practical Exam in the subject "Conservative Dentistry including Endodontics" without proper assessment of her performance by the internal examiner. Upholding the contention High Court directed the Vice Chancellor of RGUHS to conduct an enquiry and take decision, whether to hold the exam afresh.
